Terms of use

This is a legal agreement between you and Freepixels. By downloading images or digital creations from our website, you have agreed to be bound by the terms of this agreement in respect of those images and digital creations. If you do not accept or agree with these terms do not download any image or digital creation.

This is a license, not a cession. Freepixels continue to own the intellectual property rights of the images and digital creations. The images and digital creations are provided under the terms of the following license agreement that states what you may and may not do with them.

Freepixels grants to you a non-exclusive, non-transferable license to use and reproduce the images on the terms and conditions contained in this agreement.

Images and digital creations downloaded from our website may be used for both personal and commercial purposes under the limitations of this license. Any magazine, newspaper or other publication, product, design element or promotional material they appear in may be sold or distributed in any way for an unlimited number of times.

However, you may not share an image or digital creation by providing access on shared disk drives or network, resell any image or digital creation, use any image or digital creation as part of a trademark or patent image, use any image or digital creation as part of a logo, produce printed reproductions of any image or digital creation on canvas or paper to be sold, use or display any image or digital creation on websites designed to induce sales of "print on demand" products, to use these images or digital creation in connection with sensitive subjects including, but not limited to drugs, alcohol, physical abuse, contraband, crime, discrimination or defamation excepting the situation or situations when used to combat, fight or discourage such activities, use these images or digital creation in connection with any pornographic, obscene or immoral materials considered so by Freepixels. Every Freepixels image or digital creation used must retain the domain name: freepixels.com when used on the internet, in a web page, in printed publications, or in any product, advertising, or packaging. This credit, however, may be cropped out or digitally removed from the photograph if it is included in readable type near each photograph, group of photographs, in the text, or in the credits.

The rights Freepixels grants to you do not include a license to any persons, property, or subject matter depicted in an image or digital creation, which may be subject to copyrights, trademarks, rights of publicity, property rights or other rights belonging to third persons. You will assume that no model or property releases, or other releases or licenses exist in connection with any of the images or digital creations. You are solely responsible for determining whether your use of any image or digital creation requires the consent of any third party or the license of any additional rights, and you should not rely solely on the information provided by Freepixels. If you are unsure whether additional rights are needed for your use, you are responsible for consulting with competent legal counsel.

If an image contains art (including paintings, sculptures, photographs, etc.) additional licenses may be required from the artist or agency. You will need to determine whether the art depicted is protected under copyright laws, and whether your use requires that you obtain permission of the artist.

An image or digital creation containing a trademark or trade name may require you to obtain the permission of the trademark owner if your use could confuse the public as to the source, origin, or approval.

Freepixels.com and the images or digital creations are made available to you "AS IS," denying any and all warranties, express or implied that your usage of freepixels.com will be uninterrupted, error free of computer viruses or other damaging materials. When you access and acquire images or digital creations, you do so at your risk. Freepixels.com also disclaims any and all common-law duties, including without limitation duties of reasonable care and workmanlike effort. You understand that you should seek competent counsel before using the images or digital creation on or in connection with any goods or services or for any other commercial purposes.

Freepixels may at any time during the term of this agreement notify you that certain images are no longer available for use under this agreement and upon such notification the license granted by Freepixels shall automatically and immediately terminate.
